On the reorganization and streamlining of the administrative apparatus of specialized agencies under the District People’s Committee

Implementation of Resolution No. 18-NQ/TW dated 25/10/2017 by the Central Executive Committee (Session XII) on several issues of continuing innovation and organizing a streamlined political system, efficient and effective operations; Implementation Plan No. 169-KH/TU dated 26/11/2024 of the Party Committee of Nam Dinh Province summarizing Resolution No. 18-NQ/TW dated 25/10/2017;
Proposal No. 330-PA/BCSĐ dated 19/12/2024 by the Party Committee of the Provincial People’s Committee on the reorganization and streamlining of the administrative apparatus of the Provincial People’s Committee; Based on Document No. 967/UBND-VP8 dated 27/12/2024 from Nam Dinh Provincial People’s Committee on reorganizing and streamlining specialized agencies under the District People’s Committee. The People’s Committee of Xuan Truong District drafts the Project on the reorganization and streamlining of specialized agencies under the District People’s Committee as follows:
A. NECESSITY AND LEGAL BASIS
- Necessity
In recent years, the organization and operation of specialized agencies under the District People’s Committee have generally remained stable, effectively promoting state management; functions and tasks are relatively specific and clear, and the quality of state management advisory by sector and field has gradually improved.
However, some specialized agencies under the District People’s Committee are small in scale, with few assigned staff and civil servants, not meeting the minimum civil servant staffing criteria as prescribed, leading to ineffective state management implementation.
From the requirement to effectively implement the Party’s policy on continuing innovation and completing the political system from the Central to local levels, building a modern, professional, flexible, and dynamic administration, enhancing the effectiveness and efficiency of state management in various fields of specialized agencies under the District People’s Committee, the construction of the Project on the reorganization and streamlining of specialized agencies under the District People’s Committee is truly necessary.
- Legal Basis
– The 2015 Law on Organization of Local Government; the Law amending and supplementing certain articles of the Law on Organization of Government and the Law on Organization of Local Government 2019;
– Resolution No. 18-NQ/TW dated 25/10/2017 of the Central Executive Committee (Session XII) on several issues of continuing innovation and organizing a streamlined political system, efficient and effective operations.
– Resolution No. 56/2017/QH14 dated 24/11/2017 on continuing the reform of the streamlined, efficient, and effective state administrative apparatus.
– Resolution No. 10/NQ-CP dated 03/02/2018 of the Government issuing the Government’s Action Program to implement Resolution No. 18-NQ/TW dated 25/10/2017 of the Central Executive Committee (Session XII).
– Decree No. 37/2014/NĐ-CP dated 05/5/2014 of the Government regulating the organization of specialized agencies under the District, Town, and City People’s Committees; Decree No. 108/2020/NĐ-CP dated 14/9/2020 of the Government amending and supplementing certain articles of Decree No. 37/2014/NĐ-CP dated 15/5/2014 regulating the organization of specialized agencies under the District, Town, City People’s Committees of provinces and centrally-run cities.
– Decree No. 158/2018/NĐ-CP dated 22/11/2018 of the Government regulating the establishment, reorganization, and dissolution of administrative organizations.
– Plan No. 141/KH-BCĐTKNQ18 dated 06/12/2024 of the Steering Committee summarizing the implementation of Resolution No. 18-NQ/TW on the orientation plan for reorganizing and streamlining the Government’s administrative apparatus.
– Document No. 7968/BNV-CCVC dated 08/12/2024 of the Ministry of Home Affairs on the orientation for constructing the plan for staffing, arranging civil servants and public employees, and workers under the employment contract regime when reorganizing the administrative apparatus.
– Document No. 24/CV-BCĐTKNQ18 dated 18/12/2024 of the Government’s Steering Committee summarizing the implementation of Resolution 18-NQ/TW of the Government on the orientation, suggesting some contents on reorganizing specialized agencies under the Provincial and District People’s Committees.
– Proposal No. 330-PA/BCSĐ dated 19/12/2024 by the Party Committee of the Provincial People’s Committee on the reorganization and streamlining of the administrative apparatus of the Provincial People’s Committee.
– Document No. 967/UBND-VP8 dated 27/12/2024 of Nam Dinh Provincial People’s Committee on reorganizing and streamlining specialized agencies under the District People’s Committee.
B. PURPOSE, REQUIREMENTS, SCOPE, SUBJECTS AND PRINCIPLES OF REORGANIZATION
I. PURPOSE AND REQUIREMENTS
- To reorganize and streamline the internal structure of specialized agencies under the District People’s Committee, ensuring streamlined, efficient, and effective operations in accordance with legal regulations, aimed at reducing administrative units and deputy positions.
- The process of reorganization and streamlining must be conducted seriously, cautiously, scientifically, rigorously, openly, transparently, and suitably to the actual situation of the staff, civil servants, and public employees, as well as the requirements of tasks of each agency and unit after reorganization, ensuring no interruption or disruption in the performance of tasks of agencies and units.
II. SCOPE AND SUBJECTS OF APPLICATION
The project stipulates the reorganization and restructuring of specialized agencies under the District People’s Committee.
III. PRINCIPLES OF REORGANIZATION
– Strictly implement the policies, regulations, and orientations of the Central and Provincial authorities regarding the reorganization and streamlining of the administrative apparatus, ensuring uniformity, synchronization, and seamless management within administrative agencies at all levels.
– Based on the requirements of state management tasks in the locality and the administrative civil servant staffing criteria assigned by the Provincial People’s Committee to carry out the reorganization and restructuring of specialized divisions, ensuring the number of specialized divisions conforms to the regulations stipulated in Decree No. 108/2020/NĐ-CP dated 14/9/2020 of the Government and other relevant regulations.
– Rationally organize specialized agencies, applying the principle of one agency handling multiple tasks and one task being assigned to one main responsible agency.
– Temporarily halt the appointment of heads, deputy heads, and equivalent positions to prioritize the arrangement of existing heads and deputy heads during reorganization. In special cases requiring new appointments of heads, deputy heads, and equivalent positions, the District People’s Committee Chairman shall report to the Provincial People’s Committee Chairman for consideration and decision before implementing the personnel procedures.
C. CONTENT OF REORGANIZATION
I. CURRENT STATUS OF THE ADMINISTRATIVE APPARATUS OF SPECIALIZED DISTRICT-LEVEL AGENCIES
- Administrative Apparatus
– As of 01/12/2024, the Xuan Truong District People’s Committee has 11 specialized agencies, including: Department of Home Affairs, Department of Justice, Department of Finance and Planning, Department of Natural Resources and Environment, Department of Labor, Invalids, and Social Affairs, Department of Culture and Information, Department of Education and Training, Department of Agriculture and Rural Development, Department of Economy and Infrastructure, Office of the District People’s Council and District People’s Committee, and District Inspectorate.
The total number of public service units under the district is 66 units, including 62 units for Education and Training; 01 unit for Health; 01 unit for Culture and Information; 01 other public service unit; and 01 self-managed unit for investment and regular expenditures.
– The organization and operation of specialized agencies under the District People’s Committee have generally remained stable, effectively promoting state management. In accordance with the guidelines of central ministries and sectors, the District People’s Committee has issued regulations on the functions, tasks, and organizational structures of all 11 specialized agencies and 66 public service units under the District People’s Committee. The functions and tasks of the agencies and units have been specifically and clearly defined; mergers, consolidations, and transfers between agencies and units have been carried out promptly, avoiding confusion and resolving overlaps in functions and tasks among agencies and units.
Implementing Resolution No. 18-NQ/TW of the Central Executive Committee (Session XII) and the Party’s policies and State regulations; Based on the directives and guidelines of the Provincial Party Committee, the Provincial People’s Committee, and relevant departments, the District People’s Committee has gradually streamlined, reduced administrative units, streamlined personnel, and improved the effectiveness and efficiency of state management in various fields. Accordingly, from 2017 to 2024, one department and 11 public service units have been reduced.
- Staffing
2.1. The total staffing of specialized agencies in the district allocated for 2024 is 82 positions, as of December 1st, 2024 there are currently: 74/82 (8 positions yet to be arranged: Department of Finance and Planning, Department of Home Affairs, Department of Culture and Information, Department of Education and Training, Department of Agriculture and Rural Development, District Inspectorate, Office of the District People’s Council and District People’s Committee).
2.2. The number of leaders in specialized agencies (as of December 1st, 2024):
– The total number of leadership and management civil servants is 32 people (11 heads, 21 deputy heads).
– Deputy leaders in specialized agencies are arranged according to job positions, ensuring compliance with the structure and number of staff assigned by the competent authority, specifically:
– There is 01 agency with 03 deputy leaders: Office of the District People’s Council and District People’s Committee.
– There are 08 agencies with 02 deputy heads, including: Department of Home Affairs, Department of Finance and Planning, Department of Agriculture and Rural Development, Department of Labor, Invalids and Social Affairs, Department of Economy and Infrastructure, Department of Education and Training, Department of Natural Resources and Environment, and District Inspectorate.
– There are 02 agencies with 01 deputy head, including: Department of Culture and Information, and Department of Justice.
II. REORGANIZATION PLAN FOR SPECIALIZED AGENCIES UNDER THE DISTRICT PEOPLE’S COMMITTEE
- Maintain the names and functions of four departments and equivalents: Department of Justice, Department of Finance and Planning, District Inspectorate, Office of the District People’s Council and District People’s Committee.
- Reorganize and restructure the agencies:
2.1. Merge the Department of Labor, Invalids and Social Affairs with the Department of Home Affairs.
a) Name after the merger: tentatively Department of Home Affairs and Labor.
b) Functions and tasks: The Department of Home Affairs and Labor will perform the current functions and tasks of the Department of Home Affairs (according to Decision No. 01/2022/QĐ-UBND dated 01/11/2022 of the Xuan Truong District People’s Committee regulating the functions, tasks, powers, and organizational structure of the Department of Home Affairs) and the functions and tasks related to employment; labor wages; social insurance; occupational safety and health; people with meritorious services, and gender equality of the Department of Labor, Invalids and Social Affairs.
c) Staffing: Combine the current staffing according to the functions and tasks of the two units, totaling 09 people; including 05 staff from the Department of Home Affairs and 04 staff (including 01 Head, 01 Deputy Head, and 02 specialists) from the Department of Labor, Invalids and Social Affairs.
d) Organizational structure and staffing plan after the merger:
– The allocated staffing target for the Department of Home Affairs and Labor is 10 people.
– Department leadership:
+ Head: After the merger, there will be 02 people. Assign 01 person who is a member of the District Party Executive Committee as Head (as decided by the Standing Committee of the District Party Committee); 01 member of the District Party Executive Committee is proposed to be considered for transfer to another position or to act as Deputy Head.
+ Deputy Head: Temporarily retain 04 Deputy Heads after the merger (including 01 person who is currently Head to be considered for the position of Deputy Head if not transferred, 01 Deputy Head from the Department of Labor, Invalids and Social Affairs, and 02 Deputy Heads from the Department of Home Affairs).
After finalizing the department’s organizational structure, the District People’s Committee will arrange the number of Deputy Heads to ensure it does not exceed the regulation stipulated in Decree No. 108/2020/NĐ-CP dated 14/9/2020 of the Government (according to Clause 3, Article 2, which stipulates that on average, each department should have 02 Deputy Heads).
– Specialists: 05 people (short of 01 allocated staffing position not yet used for the Department of Home Affairs).
2.2. Establishment of the Department of Agriculture and Environment
a) Functions and tasks: The Department of Agriculture and Environment will assume the functions and tasks of the Department of Agriculture and Rural Development (according to Decision No. 02/2024/QĐ-UBND dated 09/5/2024 of the Xuan Truong District People’s Committee regulating the functions, tasks, powers, and organizational structure of the Department of Agriculture and Rural Development) and the Department of Natural Resources and Environment (according to Decision No. 03/2021/QĐ-UBND dated 23/7/2021 of the Xuan Truong District People’s Committee regulating the functions, tasks, powers, and organizational structure of the Department of Natural Resources and Environment).
b) Staffing: Combine the current staffing of the two units, totaling 13 people; including 07 current staff from the Department of Natural Resources and Environment and 06 current staff from the Department of Agriculture and Rural Development.
c) Organizational structure and staffing plan after the merger:
– The allocated staffing target for the Department of Agriculture and Environment is 13 people.
– Department leadership:
+ Head: After the merger, there will be 02 people. Assign 01 person who is a member of the District Party Executive Committee as Head (as decided by the Standing Committee of the District Party Committee); 01 member of the District Party Executive Committee is proposed to be considered for transfer to another position or to act as Deputy Head.
+ Deputy Head: Temporarily retain 05 Deputy Heads after the merger (including 01 person who is currently Head to be considered for the position of Deputy Head if not transferred, 02 Deputy Heads from the Department of Natural Resources and Environment, and 02 Deputy Heads from the Department of Agriculture and Rural Development). In 2029, 02 Deputy Heads from the Department of Agriculture and Rural Development will reach the retirement age and enjoy social insurance benefits according to regulations.
After finalizing the department’s organizational structure, the District People’s Committee will arrange the number of Deputy Heads to ensure it does not exceed the regulation stipulated in Decree No. 108/2020/NĐ-CP dated 14/9/2020 of the Government (according to Clause 3, Article 2, which stipulates that on average, each department should have 02 Deputy Heads). Based on the number of specialized departments established and the total number of current Deputy Heads, the District People’s Committee will consider and decide on the specific number of Deputy Heads accordingly.
+ Specialists: 07 people.
2.3. Establishment of the Department of Culture, Science, and Information
a) Functions and tasks: The Department of Culture, Science, and Information will assume the functions and tasks of the Department of Culture and Information (according to Decision No. 05/2022/QĐ-UBND dated 01/11/2022 of the Xuan Truong District People’s Committee regulating the functions, tasks, powers, and organizational structure of the Department of Culture and Information) and the functions and tasks related to Science and Technology from the Department of Economy and Infrastructure.
b) Organizational structure: Maintain the existing structure of the Department of Culture and Information, consisting of 04 people: 02 leaders, 01 civil servant specialist, and 01 seconded public employee. In October 2025, 01 Deputy Head will reach the retirement age and enjoy social insurance benefits according to regulations. It is expected to receive 01 Deputy Head to ensure appropriate job positions.
c) Staffing: The allocated staffing target for the Department of Culture, Science, and Information is 05 people (an increase of 01 staffing target transferred from the unused staffing target of the Department of Agriculture and Rural Development to perform the functions and tasks related to Science and Technology).
2.4. Establishment of the Department of Economy, Infrastructure, and Urban Development
a) Functions and tasks: The Department of Economy, Infrastructure, and Urban Development will assume the functions and tasks of advising and managing state affairs related to construction, transportation, and industry and trade from the Department of Economy and Infrastructure (after transferring the functions and tasks related to Science and Technology to the Department of Culture, Science, and Information).
b) Organizational structure: Maintain the existing structure of the Department of Economy and Infrastructure, consisting of 06 people (03 leaders and 03 specialists).
c) Staffing: The allocated staffing target for the Department of Economy, Infrastructure, and Urban Development is 06 people.
3. Adjustment of functions and tasks of agencies
3.1. Office of the District People’s Council and District People’s Committee
– In addition to the tasks of the Office of the District People’s Council and District People’s Committee according to Decision No. 04/2024/QĐ-UBND dated 27/8/2024 of the Xuan Truong District People’s Committee (regulating the functions, tasks, powers, and organizational structure of the Office of the District People’s Council and District People’s Committee), it will assume the function of advising on state management in the fields of social protection, children, and prevention of social evils from the Department of Labor, Invalids and Social Affairs.
– Organizational structure: Maintain the existing structure of the Office of the District People’s Council and District People’s Committee with 10 people (excluding the leadership of the District People’s Council and District People’s Committee and committees of the District People’s Council), and receive 03 people transferred from the Department of Labor, Invalids and Social Affairs (including 01 Deputy Head and 02 specialists).
– Staffing: The allocated staffing target for the Office of the District People’s Council and District People’s Committee is 13 people (an increase of 03 positions to perform the tasks transferred from the Department of Labor, Invalids and Social Affairs). Specifically:
+ Department leadership: Chief of Office and equivalent: 01 person; Deputy Chief of Office and equivalent: 04 people initially. Based on the number of specialized departments established and the total number of Deputy Heads and equivalents, the District People’s Committee will consider and decide on the specific number of Deputy Chiefs of Office accordingly.
+ Specialists: 09 people.
3.2. Department of Education and Training
– Maintain the name, functions, and tasks according to Decision No. 02/2021/QĐ-UBND dated 23/7/2021 of the Xuan Truong District People’s Committee (regulating the functions, tasks, powers, and organizational structure of the Department of Education and Training), and assume additional functions and tasks related to vocational education transferred from the Department of Labor, Invalids and Social Affairs.
– Organizational structure: Maintain the existing structure of the Department of Education and Training with 10 people (03 leaders and 07 specialists).
– Staffing: The allocated staffing target for the Department of Education and Training is 11 people.
- Arrangement and allocation of headquarters, assets, and finances
– The finances, budget, public assets, files, and documents of newly established and reorganized specialized departments are to be handed over, managed, and used in accordance with legal regulations and the guidance of provincial-level specialized agencies, the District Finance and Planning Department, and relevant agencies.
– The office (rooms) of newly established and reorganized units will be arranged under the direction of the District People’s Committee, ensuring that the implementation of assigned functions and tasks of the agencies, organizations, and units is not affected.
- Implementation Schedule
Newly established and reorganized specialized departments under the District People’s Committee will begin their operations following the timeline directives of the Party Committee of Nam Dinh Province, the People’s Committee of Nam Dinh Province, the Party Committee of Xuan Truong District, the People’s Council of Xuan Truong District, and the People’s Committee of Xuan Truong District.
III. RESULTS AFTER REORGANIZATION
- Number of specialized departments in the district
– Total number of departments after reorganization: 09 departments (reduced by 02 departments)
- Number of civil servants after reorganization
– Temporarily, after the merger, the District People’s Committee still has 74/82 positions, lacking 08 positions, ensuring that the number of leaders, managers, and civil servants in newly established units does not exceed the total number of leaders, managers, and civil servants prior to the reorganization.
– Based on professional qualifications, work experience, capacity, strengths, and staffing as regulated by the Provincial People’s Council to arrange, transfer, and ensure the legitimate rights and interests of civil servants (non-managerial positions) in accordance with legal regulations.
- Regarding heads and deputy heads
– Initially reduce 02 head positions.
– The arrangement and assignment of job positions for heads and deputy heads: Transfer to hold the position of deputy head or propose appointments to other suitable positions according to the actual situation of the unit (as decided by the Standing Committee of the District Party Committee), or cease holding management positions to focus on specialized tasks.
From now until 2029: 05 civil servants will retire with social insurance benefits according to regulations, including 3 deputy heads from specialized departments of the District People’s Committee (Department of Culture and Information in 2025 and Department of Agriculture and Rural Development in 2029). The District People’s Committee will arrange and assign tasks based on recruitment, reception, transfer, and rotation to work in agencies, organizations, and units within the political system according to task requirements or enjoy retirement, resignation, and staff reduction policies in accordance with Government regulations.
D. IMPLEMENTATION ORGANIZATION
- Proposal to the Standing Committee of the District Party Committee, the Executive Committee of the Standing Committee of the District Party, and the District People’s Committee:
– Focus on leadership, direction, and timely implementation of Resolution No. 18-NQ/TW dated 25/10/2017 of the Central Executive Committee (Session XII) on several issues of continuing innovation, reorganization, and streamlining of the political system for efficient and effective operations; direct the consolidation and reorganization of the administrative apparatus within the political system, arrangement of staff and civil servants, handling of public assets, and the transfer and reception process.
– Direct the implementation of mergers, establishment of party cells, and appointment of party committees as per Party regulations to ensure completeness.
- Proposal to the District Propaganda Department: Direct and guide relevant agencies to strengthen information, propaganda, and dissemination of Resolution No. 18-NQ/TW dated 25/10/2017 of the Central Executive Committee (Session XII).
- Department of Home Affairs:
– Advise the District People’s Committee on developing and issuing the Project for reorganizing specialized agencies as regulated, lead, monitor, inspect, guide, and urge implementation. Periodically or unexpectedly report the implementation results of assigned tasks to the District People’s Committee for compilation and reporting to the District Party Committee, Provincial People’s Committee, and Department of Home Affairs as regulated.
– Advise the District People’s Committee on deciding the list, number of job positions, and plan for staff reduction, restructuring the team of civil servants, especially those holding leadership and management positions, in accordance with the law and the actual situation of the locality.
– Guide the implementation of resolving regimes and policies for staff and civil servants when reorganizing the administrative apparatus; guide specialized agencies to review, compile, and hand over, store documents as regulated by the current Archive Law.
– Advise the District People’s Committee on summarizing and concluding the implementation of administrative apparatus streamlining and related emulation and commendation.
- Department of Finance and Planning:
– Advise the District People’s Committee on managing and using finances, budgets, and public assets when reorganizing specialized district-level agencies as regulated.
– Guide, monitor, compile, and organize the handover of assets, funds, management, and use of budget funds and state assets at new units after reorganization as per authority.
– Advise the District People’s Committee on arranging financial resources for implementing the streamlining of the administrative apparatus for agencies and units.
- Department of Culture and Information
The Department of Culture and Information will take the lead, coordinating with the Center for Culture, Information, and Sports, relevant agencies, units, and localities to effectively conduct information dissemination, propaganda, and popularization regarding the policy of streamlining the administrative apparatus according to the spirit of Resolution No. 18-NQ/TW of the Party, aimed at gaining consensus among officials, civil servants, public employees, party members, and the public on the reorganization and streamlining of state agency structures.
- District Police
– Take the lead, coordinating with relevant agencies to guide and implement the retrieval of old seals, and create new seals for the reorganized agencies and units; ensure compliance with regulations in the reorganization within the district.
- For agencies subject to reorganization, merger, or adjustment of functions and tasks:
– Coordinate with the District Department of Home Affairs to develop a project for reorganizing specialized agencies under the District People’s Committee; review, compile, and inventory physical facilities, assets, equipment, files, and documents to conduct handover when there is a merger decision from the competent authority, ensuring no disruption to the work of units during reorganization.
– Request functional agencies to guide the implementation of creating new seals and retrieving old seals to perform tasks as regulated.
– Proactively coordinate to advise the District People’s Committee on adjusting functions, tasks, powers, organizational structures, and job positions of the new units to ensure compliance with legal regulations after reorganization.
– Propose to the Standing Committee of the District Party Committee and relevant authorities to decide on the establishment and consolidation of Party Committee personnel and leadership of mass organizations according to decentralization.
- For departments that remain unchanged and do not have adjustments to their functions and tasks: The District Inspectorate and the District Department of Justice continue to perform their tasks, ensuring the structure, effective, and efficient operations.
