I. Increase retirement age of employees from January 1, 2023

According to Article 169 of the 2019 Labor Code, the retirement age of employees is:

  1. Increase pensions and social insurance benefits from July 1, 2024

Pursuant to Decree No. 75/2024/ND-CP dated June 30, 2024 of the Government on adjusting pensions, social insurance benefits and monthly allowances, from July 1, 2024, the increase in pensions, social insurance benefits and groups entitled to benefits will be as follows:

– Pension, social insurance benefits and monthly allowances in June 2024 will increase by 15% .

– Pensioners, social insurance beneficiaries and monthly beneficiaries before January 1, 1995 , after adjustment, whose benefit level is lower than VND 3,500,000/month , will continue to be adjusted as follows:

+ If the benefit is less than 3,200,000 VND/month , it will increase by 300,000 VND/month .

+ If the benefit level is from 3,200,000 VND/month to less than 3,500,000 VND/month , it will increase by 3,500,000 VND/month .

Groups increased:

  1. Cadres, civil servants, workers, public employees and laborers (including those who have participated in voluntary social insurance, retirees from the Nghe An farmers’ social insurance fund); soldiers, people’s police and people working in key positions who are receiving monthly pensions.
  2. Commune, ward and town officials specified in Decree No. 33/2023/ND-CP , Decree No. 92/2009/ND-CP , Decree No. 34/2019/ND-CP , Decree No. 121/2003/ND-CPand Decree No. 09/1998/ND-CP .
  3. People receiving monthly allowances for loss of working capacity according to the provisions of law; people receiving monthly allowances according to Decision No. 91/2000/QD-TTg, Decision No. 613/QD-TTg; rubber workers receiving monthly allowances according to Decision No. 206-CP .
  4. Commune, ward and town officials who are receiving monthly allowances according to Decision No. 130-CP1975and Decision No. 111-HDBT 1981.
  5. Soldiers receiving monthly allowances according to Decision No. 142/2008/QD-TTg .
  6. People’s Public Security is receiving monthly allowance according to Decision No. 53/2010/QD-TTg .
  7. Military personnel, people’s police, and people working in secretarial work receive salaries similar to those of military personnel and people’s police who are receiving monthly allowances according to Decision No. 62/2011/QD-TTg .
  8. People receiving monthly occupational accident and disease benefits.
  9. People receiving monthly pension benefits before January 1, 1995.

New regulations on social insurance benefits

Six new regulations on social insurance benefits from February 15, 2023 according to Circular 18/2022/TT-BYT

Amendment of cases eligible for one-time social insurance benefits

Amend the first medical examination records to receive social insurance

Be proactive in re-examining work accidents and occupational diseases to receive social insurance

The number of days off on the leave certificate entitled to social insurance can be up to 50 days.

Supplementing regulations on granting certificates of leave to receive social insurance for people infected with Covid-19

Be required to issue a certificate of leave to receive social insurance if you go to the doctor but have not yet issued one.

5.1. Amendment of cases eligible for one-time social insurance benefits

Old rules

According to Clause 1, Article 1 of Circular

18/2022/TT-BYT

Cancer, paralysis, cirrhosis, leprosy, severe tuberculosis, HIV infection that has progressed to AIDS stage and at the same time cannot control or perform activities of walking, dressing, personal hygiene and other daily activities that need to be monitored, assisted and completely cared for by someone.

– Diseases and disabilities other than the above diseases that have a reduced working capacity or disability level of 81% or more and cannot control or perform activities of walking, dressing, personal hygiene and other activities to serve daily personal needs and require someone to monitor, assist and take complete care of them.

– In case of being suffering from one of the life-threatening diseases such as cancer, paralysis, cirrhosis, leprosy, severe tuberculosis, HIV infection that has progressed to AIDS stage as prescribed in Point c, Clause 1, Article 60 of the Law on Social Insurance;

– People with diseases or disabilities that reduce their ability to work by 81% or more and cannot control or perform daily personal activities on their own and need someone to monitor, assist, and provide complete care.

According to this regulation, if an employee unfortunately gets cancer, he or she can receive social insurance one time.

  2. 5.2. Amending the first medical examination records to receive social insurance
  3. Clause 2, Article 1 of Circular 18/2022/TT-BYT has amended the initial medical examination records for social insurance benefits in Article 5 of Circular 56/2017/TT-BYT.

5.3. Be proactive in re-examining work accidents and occupational diseases to receive social insurance.

– Employees who have had work-related accidents or occupational diseases have undergone health examinations to receive work-related accident and occupational disease benefits. It is completely possible to proactively go for a re-examination to assess the level of reduced working capacity if needed .

– The Labor Accident and Occupational Disease Insurance Fund will pay for re-examination if the examination results determine that the employee is eligible for an increase in the level of occupational accident and occupational disease benefits .

– Conversely, if the re-examination results are not sufficient to increase the subsidy level, the employee who proactively requests a re-examination will have to bear the cost of the examination .

– In cases of re-assessment of work-related accidents and occupational diseases, the re-assessment period must be at least 02 years from the date the Medical Assessment Council concludes the employee’s previous rate of decline.

5.4. The number of days off on the leave certificate entitled to social insurance can be up to 50 days.

Clause 2, Article 20, Circular No. 56/2017/TT -BYT regulations

Article 1, Clause 18 Circular 18/2022/TT -BYT adds the following regulations

Only one social insurance leave certificate is issued per examination. In case the patient needs to take leave for more than 30 days, when the leave period stated on the social insurance leave certificate has expired or is about to expire, the patient must undergo a re-examination for the practitioner to consider and decide.

In case an employee has a miscarriage, abortion, curettage, suction curettage, or stillbirth with a gestational age of 13 weeks or more, the maximum leave period is according to the provisions of the Law on Social Insurance, but not more than 50 days for one time of issuing a certificate of leave to receive social insurance.

 

 

According to this regulation, the number of days off on the leave certificate entitled to social insurance can be up to 50 days. Previously, according to Circular No. 56/2017/TT-BYT, the maximum number of days off to social insurance in all cases was 30 days.

5.5. Supplementing regulations on granting certificates of leave to receive social insurance for people infected with Covid-19 (stipulated in Clause 13, Article 1 of Circular 18/2022/TT-BYT)

People infected with COVID-19 who are treated as inpatients or outpatients at the following medical examination and treatment facilities are granted a certificate of leave to receive social insurance:

– Medical examination and treatment facilities are established in accordance with the provisions of the Law on Medical Examination and Treatment 2009;

– COVID-19 admission and treatment facilities are established according to the provisions at Point a, Clause 1, Article 1 of Resolution 168/NQ-CP, as follows:

+ Field hospital for COVID-19 treatment;

+ COVID-19 treatment hospital;

+ COVID-19 emergency resuscitation hospital;

+ Intensive care center for COVID-19 patients.

5.6. Be required to issue a certificate of leave to receive social insurance if you go to the doctor but have not yet issued one.

Clause 18, Article 1 of Circular 18/2022/TT-BYT has added the following provision:

In case the employee has been examined and treated but has not been granted:

+ Hospital discharge papers, birth certificates, maternity leave certificates;

+ Certificate of not being healthy enough to take care of the child after birth;

+ Certificate of leave to receive social insurance;

Then the employee is required to issue a certificate of leave to receive social insurance if he/she goes to the doctor but has not been issued one .

Note:

– The date/month/year of issuance of the Social Insurance Leave Certificate must coincide with the date the employee comes for a medical examination .

– In case the medical examination lasts 2 days or more , the date/month/year of issue must coincide with the last day of the employee’s medical examination and must be assigned outpatient leave.
